Right of withdrawal

Art.1 Right of withdrawal

Pursuant to articles 52 and SS. of the Consumer Code, the Customer who covers the quality of consumer has the right to withdraw from the purchase contract of the product without having to bear costs other than the direct ones of the return of the goods, as provided in this section and without having to provide any motivation, by term of fourteen calendar days ("period of withdrawal").

The withdrawal period expires after 14 (fourteen) days from the day when the consumer customer or a third, different from the carrier and designated by him, acquires the physical possession of the products. In the case of multiple products ordered by the consumer through a single order and delivered separately, the right of withdrawal starts from the day when the consumer or a third party, other than the carrier and designated by the consumer, acquires the physical possession of the last product. In the case of delivery of a product made up of lots or multiple pieces, it starts from the day when the consumer or a third, different from the carrier and designated by the consumer, acquires the physical possession of the last lot or piece.

Art.2. Method of exercising the right of withdrawal

2.1 Before the expiry of the withdrawal period, the customer who covers the qualification of consumer must inform Manta Distribution Srls of his decision to exercise the right of withdrawal from the distance contract. To this end, the consumer can:

a) use the type of withdrawal form on the site, or request the NAR form via email; b) to submit any other explicit declaration of his decision to withdraw from the distance contract, transmitting it without any formality to any of the contact details indicated in these general conditions of sale or present on the site. The communication of the withdrawal thus early and always sent within the deadline of 14 days must be followed by a confirmation by registered letter with acknowledgment of receipt, sent no later than 48 hours after Manta Distribution Srls, via dei Colli Portuensi 252, Rome (RM).

The consumer has exercised his right of withdrawal within the withdrawal period if the communication relating to the exercise of the right of withdrawal is sent in the manner described above by the consumer before the expiry of the withdrawal period. The burden of proof relating to the exercise of the right of withdrawal in accordance with this article looms on the consumer.

2.2 Once the communication of withdrawal has been received, Manta Distribution Srls will communicate to the consumer a confirmation of receipt, on a durable support (since this is also an e -mail account and a declared email address), of the withdrawal exercised. The customer service will quickly communicate the instructions to the customer on the return method, assigning a unique code of RMA for the return of the goods, this code will be inserted on the n.a.r. module module Downloadable then and sent via email to the following address: info@phone2go.it and affixed to the package used for the shipment of the property.

2.3 The product, suitably packed and protected, must be sent to Manta Distribution Srls without undue delay and in any case within the deadline of 14 calendar days from the date on which the customer communicated to Manta Distribution Srls his decision to withdraw. The term is respected if the customer sends the product before the 14 -day period expires. The customer must return the product to Manta Distribution Srls using a carrier of his own choice. The direct costs of returning the product are borne by the customer.

2.4 The products sold on the site are original and are sent to their authentic packaging. During the return, the products must be returned as received, in their original packaging, and including any accessories and/or elements that make up an integral part of it. To limit damage to the original packaging, it is required to insert it in a second box, on which to affix the label provided by Manta Distribution Srls reporting the number of N.A.R. (Return authorization code). Sticker labels or tapes are not affixed directly to the original packaging of the product which must not be tampered or altered in any other way. Failure to comply with this prescription will be relevant in order to decrease the value of the asset and/or for the purposes of the validity of the withdrawal.

2.5 The shipment is under the complete responsibility of the customer until the time of the return to Manta Distribution Srls and, for the effect, Manta Distribution Srls does not respond to damage, theft or loss of the BEI returned. For this reason it is recommended to make an insured delivery. In the event of damage to the good during transport, or other criticality, Manta Distribution Srls will promptly communicate to the customer, to allow him to act against the courier chosen by him for compensation (if insured). In this case, the product will be made available to the customer for its return, and the request for withdrawal will be canceled.

2.6 Upon arrival in the warehouse, the product will be examined to evaluate any damage or tampering not deriving from transport. If the original packaging and/or packaging is ruined, Manta Distribution Srls will hold back from the refund due to a percentage, corresponding to the decrease in value of the asset and as a contribution to the restoration costs. In the event that the product for which the withdrawal has been exercised has undergone a decrease in value resulting from a manipulation of the good different from that necessary to establish the nature, characteristics and functioning of the product, the reimbursement amount will be reduced of an amount equal to this decrease in value. Of the circumstance and the consequent decreased reimbursement amount Manta Distribution Srls will notify the Customer, by e-mail, within 5 working days of receipt of the product, providing the same, in the event that the refund has already been paid, the bank details for the payment of the amount due by the customer due to the decrease in product value.

2.7 Without prejudice to the provisions of the previous point, Manta Distribution Srls will reimburse the Customer the amount relating to the purchase of the goods, within 14 days from its return, through the Storno procedure using the same payment vehicle used by the consumer for the transaction initial.

Art. 3. Limits and conditions for the exercise of the right of withdrawal

3.1 The integrity of the asset is an essential condition for the exercise of the right of withdrawal. The right of withdrawal decays due to lack of the essential condition of integrity of the asset (package and/or its content).

The goods must therefore be returned integrated, not used, complete with all its parts and in the original packaging, (including any documentation and accessory equipment: manuals, cables, etc ...). Therefore:

The products will not have to present any sign of use, even partial, of the asset and of any consumables;
The products must be returned with the external package and/or the original internal packaging;
The products must be returned with all the accessory and integral elements of the product (accessories, cables, manuals, parts, ...);
The products must be returned without signs of damage for causes other than its transport.

3.2 Any shortcomings in the packaging or signs of use on the good, (for example removal of seals or protections placed by the manufacturers) will be relevant for the purpose of evaluating the decrease in value of the property, with the consequent reduction of the sum re -conceived to the customer.

3.3 The withdrawal also finds application to the product in its entirety. It cannot be exercised in relation to parts and/or accessories of the product (e.g. accessories, attached software, etc ...).

3.4 The law does not apply to audiovisual products or sealed computer software (including those attached to hardware material) once open. Therefore, in the purchase of electronic products necessarily containing software, the right of withdrawal cannot be exercised.

3.5 The discrepancy between the image accompanying the descriptive card of a product and what was received by the customer, relating to ancillary elements such as color, size or other, is not a valid reason to operate the right of withdrawal.

3.6 In the event that the withdrawal has not been exercised in accordance with the provisions of applicable legislation and, in particular, in the event that the product is not intact in all its parts and/or accompanied by its accessories and/or by elements that They constitute an integral part (e.g.: identification number, seal, cables, batteries, manuals, ...), it will not entail the termination of the contract and, consequently, will not entitle the refund of what was paid by the customer for the product. Manta Distribution Srls will notify the customer by e-mail within 5 working days of receipt of the product, rejecting the request for withdrawal. In the case of forfeiture of the right of withdrawal, the goods will remain at the Manta Distribution Srls office available to the Customer for the withdrawal that must take place at the expense and under the responsibility of the customer himself.
